This Disclaimer applies to your use of the SetStay mobile application and website ("Platform"), operated by ATW Stays (OPC) Private Limited, for booking flights, hotels, and activities, and for using the SS Wallet. It should be read together with our Terms & Conditions and Refund & Cancellation Policy.
SetStay is a technology-driven booking facilitator. We do not operate any aircraft, own or manage any hotel property, or conduct any tour or activity ourselves. All flights, hotel stays, and activities booked through the Platform are provided by independent third parties — airlines, hotels/properties, and activity/tour operators — sourced through SetStay's technology and supply partners. Your contract for travel, stay, or the activity itself is with that underlying provider, on their own terms and conditions, fare rules, or rate policy, which SetStay has no control over.
Prices, availability, schedules, room/rate descriptions, inclusions, images, and activity details shown on the Platform are sourced from the relevant airline, hotel, activity operator, or SetStay's supply partners, and are subject to change without notice until your booking is confirmed and paid for. SetStay makes reasonable efforts to keep this information accurate and current but does not warrant that it is error-free, complete, or that the final price/availability re-verified at payment will always match what was shown during search. In particular, an activity's exact cancellation policy is not always available to us through the live booking system — see our Refund & Cancellation Policy for how to confirm it before or after booking.
SetStay does not warrant or guarantee the quality, safety, timeliness, or suitability of any flight, hotel, or activity booked through the Platform. Any complaint about the actual travel, stay, or activity experience (e.g. flight delay, room condition, activity conduct) is between you and the underlying provider; SetStay will make reasonable efforts to assist in escalating such complaints to the provider but does not guarantee any particular outcome or compensation.
It is solely your responsibility to carry valid, original government identification for check-in/check-out at a hotel, boarding a flight, or participating in an activity, and — for international travel — a valid passport, visa, and any other document required by the destination, transit, or origin country. SetStay does not verify visa eligibility or document validity and is not liable for denied boarding, denied check-in, or travel disruption arising from missing or invalid documents.
The Platform may contain links to, or content/images sourced from, third-party websites or supply partners (e.g. a hotel's own photos, or an activity operator's description). SetStay is not responsible for the content, accuracy, or privacy practices of any third-party site, and including such a link or content does not imply SetStay's endorsement of it.
Nothing on the Platform constitutes financial, legal, immigration, or travel-safety advice. Fare comparisons, "best fare" labels, or similar indicators are generated by our own systems for convenience and are not a guarantee that a lower price does not exist elsewhere.
SetStay is not responsible for any failure, delay, or inability to provide a booking or service caused by circumstances beyond its reasonable control, including airline/hotel/operator strikes, closures, or insolvency, natural disasters, government action, pandemics, or disruption to internet, telecom, or payment infrastructure.
SetStay does not guarantee that the Platform will be available at all times, free of errors, or uninterrupted. Scheduled maintenance, technical issues, or circumstances beyond our control may temporarily affect access to the app or website.
SetStay will never call, SMS, or message you asking for your full card number, CVV, UPI PIN, or one-time password (OTP), and never asks you to make a payment to a personal bank account or UPI ID outside the Platform's own payment flow. Any communication claiming to be from SetStay that asks for this is fraudulent — do not share any information or make any payment, and report it to SetStay Customer Care at (011) 69296230 or support@setstay.com immediately.
To the maximum extent permitted by law, SetStay's liability for any claim arising from your use of the Platform or any booking made through it is limited to the service fee actually paid by you to SetStay for that booking, as further detailed in our Terms & Conditions.
This Disclaimer is governed by the laws of India and is subject to the Dispute Resolution and Jurisdiction clause in our Terms & Conditions (arbitration seated in New Delhi, and exclusive jurisdiction of the courts at New Delhi).
